Trademark Application
Ata Patent Group handles trademarks for a wide range of companies, large and small, emerging and established, domestic and foreign.
Trademark Opposition
An opposition is a proceeding in which one party is seeking to prevent registration of another party's trademark. If Turkish Patent Institute (TPI) approves that a trademark application meets the criteria of a trademark, the application will be published in the Official Trademark Bulletin, so that it will be made available to the public for review.
Trademark Refusals
If a trademark application is refused by TPI’s one of trademark examiners after such review, the applicant is entitled to appeal the said refusal by filing an appeal petition to the Re-Evaluation and Examination Board (REEB) of TPI within 2 months from the date on which the said refusal has been notified to the applicant.
Trademark Appeals
Ata Patent Group handles trademark registration, opposition against a trademark application, and trademark infringement law suits for a wide range of companies.
Trademark Cancellation
Trademark cancellation law suits have several grounds. However, these cases are usually filed for reasons of prior usage or registration. Except for the reason of non-usage, the burden of proof is always on the plaintiff. The disclosure of evidence covering prior usage also becomes important before filing the lawsuit.
Trademark Assignment
Ata Patent Group's Trademark attorneys have represented both the assignees and assignors in various trademark assignments for trademarks that were registered in Turkey. Our attorneys some times prepared assignment agreements for our clients and follow up the assignment procedures.
Trademark Renewals
In order to prevent the cancellation of a registered trademark, trademark owners are required to periodically file their trademark renewals documents with Turkish Patent Institute at 10 years following the date of registration, and every ten years thereafter.
Trademark Infringement
A registered trademark owner may ask a Civil IP Court to make a judgment ordering the defendant to stop all infringing activities and make compensation for all damages. The judgment of the IP Court may also include the confiscation and destruction of counterfeit products, along with machinery and other equipment used to produce the counterfeits.
Trademark Search
One of the most important steps in trademark registration procedure is to conduct an extensive trademark search in order to identify potential conflicts with existing trademarks and as a confirmation that your trademark is almost available for registration.
Our patent & trademark attorneys are licensed to practice before Turkish Patent Institute to represent our clients' all types of intellectual property rights; including applications, registrations, and oppositions. Our IP litigation attorneys render patentability and patent, trademark, and copyright infringement opinions; litigate to protect intellectual property; handle arbitration, mediation, and other litigation alternatives; and negotiate licenses, franchising, and similar business transactions to maximize the value of such property.
